Torrance Memorial Health Information Exchange User Agreement
Torrance Memorial Health Information Exchange (TMHIE) is used for accessing patient information for the purposes of Treatment, Payment, and Healthcare Operations (TPO). TMHIE Members are responsible for identifying authorized users within their organization and you have been identified as an authorized user of a TMHIE Member. AS A TMHIE USER, YOU HAVE CERTAIN IMPORTANT RESPONSIBILITIES. By using TMHIE, you acknowledge and agree to the following:
I agree that I will only access TMHIE for purposes of Treatment, Payment, and Healthcare Operations (TPO) specifically authorized by TMHIE and HIPAA rules and regulations, federal law (including but not limited to HIPAA) and state law (including but not limited to SB 541 and CA Confidentiality of Medical Information Act).
I understand that the information about a patient contained in TMHIE may not be the patient's full medical history and agree that it is my responsibility to obtain a full history on each patient that I treat.
I understand that I will be issued one password to allow me access to TMHIE. I agree passwords cannot be shared with anyone else. If I become aware that a password has been shared, lost, or stolen, I agree that I will notify the TMHIE Administrator immediately by contacting the Torrance Memorial Medical Center Service Desk at 310-517-4741. I agree to accept responsibility for all activities I undertake using my password, and I further agree to accept all responsibility for my failure to safeguard my password.
I agree that I will require any individual under my control to protect the confidentiality of the patient information obtained from TMHIE.
I agree to comply with all applicable federal, state, and local laws, statutes, and regulations that relate to the confidentiality of patient medical records, as well as the rules and regulations of the institution at which I provide health care.
I understand that TMHIE reserves the right to monitor all activity on the site. I understand that my failure to abide by the agreement and any rules created by TMHIE may result in my exclusion from TMHIE and my constitute cause for disciplinary action, civil liability, and/or criminal penalties.
I agree to comply with all of the foregoing agreements and obligations and accept responsibility for any and all claims, actions, losses or liabilities arising from my failure to comply.
